A BILL FOR AN ACT
RELATING to the UNIVERSITY of HAWAII System.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 304A, Hawaii Revised Statutes, is amended by adding a new section to part VI to be appropriately designated and to read as follows:
"§304A- Naming rights to West Oahu campus buildings. (a) Beginning with the date of the opening of the four-year West Oahu campus in Kapolei, the board of regents shall auction the naming rights, subject to subsection (b), to any building or facility on the University of Hawaii-West Oahu campus; provided that the auction shall be exempt from chapter 103D. The period of the contract to name a building shall be for ten years. The board of regents shall evaluate each bid and award the bid to the highest bidder that the board of regents determines to be most qualified to fulfill the financial obligations of the contract over a ten-year period. Proceeds from the auction shall be deposited into the University of Hawaii-West Oahu special fund established in section 304A-2166.
(b) The name of a building or facility pursuant to subsection (a) shall be subject to the approval of the board of regents, on recommendation of a committee composed of five persons named by the chancellor of the West Oahu campus to review and approve the naming of the building or facility; provided that corporate names or offensive names shall be prohibited; provided further that the name of a deceased person, historical figure, or legendary person that the successful bidder desires to honor or memorialize shall be allowed."
SECTION 2. Section 269-101, Hawaii Revised Statutes, is amended by amending the definition of "eligible customer-generator" to read as follows:
""Eligible customer-generator"
means a metered residential or commercial customer, including a government
entity[,] and including the University of Hawaii-West Oahu campus in
Kapolei, pursuant to section 304A-2166, of an electric utility who owns and
operates a solar, wind turbine, biomass, or hydroelectric energy generating
facility, or a hybrid system consisting of two or more of these facilities,
that is:
(1) Located on the customer's premises;
(2) Operated in parallel with the utility's transmission and distribution facilities;
(3) In conformance with the utility's interconnection requirements; and
(4) Intended primarily to offset part or all of the customer's own electrical requirements."
SECTION 3. Section 304A-2166, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) There is established the University of Hawaii-West Oahu special fund. The proceeds of the special fund shall be used for the following purposes:
(1) Planning, land acquisition, design, construction, and equipment necessary for the development of the permanent campus of the University of Hawaii-West Oahu in Kapolei; and
(2) Planning, land acquisition, design, improvement,
and construction of infrastructure and other public or common facilities
necessary for the development of the permanent campus of the University of
Hawaii-West Oahu in Kapolei[.];
provided that proceeds from any auction pursuant to section 304A- shall be expended to plan, design, install, and operate an electricity generation system from renewable energy resources, including but not limited to, solar or wind-generated energy."
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
