RELATING TO REAL PROPERTY. Permits the registrar of the bureau of conveyances to accept electronic documents with electronic signatures for recording. Requires the judiciary to study what effect electronic recording may have on the adjudication of land court applications, determine permissible uses for electronic recording, and report its findings to the legislature prior to 2009 regular session.

RELATING TO PUBLIC LANDS. Permits a current lessee of public land to be disposed by public auction to match the winning bid under certain circumstances.

RELATING TO LIABILITY. Provides that an irrigation system owner shall owe no duty of care to a trespasser who enters onto land containing or bordering an irrigation system.

RELATING TO LANDOWNER LIABILITY FOR NATURAL CONDITIONS. Codifies common law regarding non-liability of landowners regarding natural conditions on their land that cause damage outside the land and applies standard of negligence upon public landowners regarding natural conditions that cause damage on public roadways.

RELATING TO HISTORIC PRESERVATION. Extends the time allowed to acquire the lands designated as part of the South Kona Wilderness Area on the island of Hawaii.

RELATING TO HISTORIC PRESERVATION. Clarifies that a burial site may include a cave or lava tube. Defines burial cave.

RELATING TO HISTORIC PRESERVATION. Requires a private or public owner of a historic building to provide archival quality black and white photographs of the building to the department of land and natural resources, as a condition of receiving a permit or approval to demolish, construct, or otherwise alter that building.

RELATING TO HA`IKU VALLEY. Establishes the Ha‘iku Valley cultural preserve commission to have policy and management oversight of the Ha‘iku Valley cultural preserve.

RELATING TO LAND CONSERVATION. Provides a tax credit to encourage the preservation and protection of conservation land in the State.

RELATING TO IRRIGATION. Exempts, from the purview of the Public Utilities Commission, any person who controls, operates, or manages irrigation facilities for transmitting nonpotable water for private, nondomestic use.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
