RELATING TO COURT-APPOINTED COUNSEL AND GUARDIANS AD LITEM IN FAMILY COURT. Clarifies compensation rates for court-appointed attorneys and Guardians Ad Litem in family court.

RELATING TO SMALL CLAIMS COURT. Changes the maximum amount in controversy in all cases for the recovery of money brought in small claims court from $3,500 to $5,000, as well as the maximum amount claimed owed in all cases for the return of leased or rented personal property brought in small claims court from $3,500 to $5,000 and the maximum worth of that leased or rented personal property from $3,500 to $5,000.

RELATING TO THE JUDICIARY. Requires the judiciary to establish a program for counties whose land area is greater than 4,000 square miles that allows for remote processing of first time citations for traffic violations. Requires a report to legislature. Appropriates funds.

RELATING TO THE INTERMEDIATE APPELLATE COURT. Authorizes the intermediate appellate court to subpoena and compel the attendance of witnesses and compel the production of books, papers, documents, or tangible things. Authorizes any intermediate court of appeals judge to administer oaths.

RELATING TO DISTRICT COURT JURISDICTION. Increases the amount over which the District Court has jurisdiction in civil cases from $20,000 to $30,000.

RELATING TO APPELLATE JURISDICTION. Authorizes immediate appeals from certain court orders regarding injunctions and denials of sovereign, absolute, or qualified immunity.

PROPOSING AN AMENDMENT TO THE HAWAII CONSTITUTION TO EXTEND THE MANDATORY RETIREMENT AGE FOR STATE JUSTICES AND JUDGES FROM SEVENTY TO EIGHTY YEARS OF AGE. Proposes a constitutional amendment to change the mandatory retirement age of justices and judges from 70 to 80 years of age.

RELATING TO POST CONVICTION PROCEEDINGS. Establishes time limits for filing habeas corpus complaints and limits successive complaints.

RELATING TO THE WIRELESS ENHANCED 911 BOARD. Deletes quorum by proxy and authorization for a board member to vote by proxy submitted in writing to the board.

PROPOSING AN AMENDMENT TO ARTICLE V, SECTION 2 OF THE CONSTITUTION OF THE STATE OF HAWAII RELATING TO THE ELECTION OF THE LIEUTENANT GOVERNOR. Proposes an amendment to article V, section 2 of the Constitution of the State of Hawaii to provide that candidates for the office of lieutenant governor be formally selected by official political parties.

· By fax: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
· By Email: Testimony may be emailed if less than 5 pages in length, to the Legislature's Public Access Room at testimony@capitol.hawaii.gov. Please indicate to which committee the testimony is being submitted and the date and time of the hearing. Email sent to individual offices or any other Senate office will not be accepted.
Please note: If you submit your written testimony after 4:30 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. Written copies of your testimony will not be distributed during the hearing but will be posted online for the public after the hearing.
If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign or foreign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
