Specifies that it is not an unfair method of competition or an unfair or deceptive act or practice for an accident and health or sickness insurer with a market share of less than 5 percent to refuse to issue or renew a policy with a prospective insured unless the prospective insured contracts for another class or an additional policy of the same class of insurance with the same insurer. RELATING TO CIGARETTES. Establishes a process to ensure that only fire-safe cigarettes are sold in Hawaii. (HB2438 HD2)

RELATING TO HEALTH. Requires Department of Taxation (DOTAX) to defer general excise tax collection for a for-profit hospital group that provides services to an annual patient population consisting of 60 percent or more uninsured, Medicaid and Medicare patients for hospital operations between July 1, 2008, and an unspecified date. Also requires DOTAX to collect the deferred taxes plus interest after the unspecified date. Provides for immediate payment of deferred taxes, interest, and penalty upon occurrence of certain events. MAKING AN EMERGENCY APPROPRIATION TO THE HAWAII HEALTH SYSTEMS CORPORATION Appropriation of general funds for fiscal year 2007-2008 to pay current, essential vendors, reduce accounts payable, and allow operation and provision of current levels of service in Hawaii Health Systems Corporation’s facilities.
