Amends the procedure for the adoption, amendment, or repeal of rules to conform to federal law.

RELATING TO CIVIL PENALTIES FOR VIOLATIONS ON PUBLIC LANDS.

Increases civil penalty fine amounts for violations on public lands and clarifies penalties for encroachment on public lands.

RELATING TO ATTORNEYS.

Changes the procedure for determining representation of any court or judicial or legislative office by the attorney general.  Also allows a board, commission, or agency to retain outside counsel under certain circumstances if the AG declines representation based on a conflict of interest.

RELATING TO SURCHARGE FOR INDIGENT LEGAL SERVICES.

Increases indigent legal services funding by increasing the surcharge on initial filing fees for civil actions.

RELATING TO SEX OFFENDER REGISTRATION.

Establishes a working group to determine what changes to Hawaii law are necessary to comply with the federal Adam Walsh Act.  Requires working group also to determine whether cost of compliance outweighs loss of 10 percent of Department of Justice grant funds that will result from noncompliance by July 29, 2009.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

·     Testifier's name with position/title and organization;

·     The date and agenda no. of the hearing;

·     Measure number;

·     If you will be testifying in person or submitting written testimony only;

·     The Committee the comments are directed to; and

·     The number of copies the Committee is requesting. 

 

While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

PAPER:    2 copies to Room 306 in the State Capitol.  It is required that the copies be on one side of an 8½ " X 11" sheet;

EMAIL:    For comments less than 5 pages in length, transmit to FINtestimony@Capitol.hawaii.gov.  Please include the              measure number, date of hearing, and agenda no. in the subject line or click on the appropriate "Email Testimony"       link above.

 

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.

 

If you require special assistance or auxiliary aids and/or services to participate in the House public hearing process (i.e., sign or foreign language interpreter or wheelchair accessibility), please contact the Committee Clerk at 586-6200 or email your request for an interpreter to HouseInterpreter@Capitol.hawaii.gov at least 24 hours prior to the hearing for arrangements.  Prompt requests submitted help to ensure the availability of qualified individuals and appropriate accommodations.
