Appropriates funds to contract for the planning and implementation of a statewide agricultural cooperative.

Establishes a process for the planning and establishment of a statewide agricultural cooperative.

RELATING TO STATE ENTERPRISE ZONES.

Qualifies agricultural businesses for enterprise zones and allows them to receive benefits in case of force majeure.  Counts leased employees and joint employment workers in hiring formulas.  Changes hiring increases for certain years of operation.  Qualifies certain value-added agricultural sales towards certification for income tax credit and disallows general excise tax exemption for agricultural product retail sales.

RELATING TO THE AGRIBUSINESS DEVELOPMENT CORPORATION.

Makes the Agribusiness Development Corporation an attached agency of the Department of Business, Economic Development, and Tourism, instead of the Department of Agriculture.  Requires DBEDT to provide its expertise to ADC.  Requires the composition of the Board of ADC to include certain secondary industries related to agriculture.

RELATING TO ANIMAL QUARANTINE FACILITIES.

Allows the Department of Agriculture to negotiate the lease rent for use of the Animal Quarantine Station located in Halawa Valley on Oahu.

RELATING TO ORGANIC AGRICULTURE.

Establishes an organic agriculture task force under the direction of the department of business, economic development, and tourism to focus on the promotion of organic agriculture as a key industry for the State.  Makes an appropriation to the task force to carry out its purposes.

RELATING TO PROCUREMENT.

Prohibits the chief procurement officer from delegating its authority to resolve protested awards; allows reimbursement of attorney's fees for protesting parties that prevail; transfers the review function of state procurement determinations to the office of the ombudsman.

RELATING TO PUBLIC PROCUREMENT.

Establishes procedures and criteria and appropriates funds to prevent state or county purchases from businesses that operate sweatshops.

RELATING TO PLANNING.

Requires office of planning, in conjunction with county planning departments, to develop a state land use plan that takes economic development into account and to submit the plan in a report to the legislature no later than twenty days prior to the convening of the regular session of 2009.
