RELATING TO TIME SHARE PLANS.

Exempts the offer or sale of a time share interest from the time share law if the offer or sale is for an additional interest in the same time share plan to an existing owner.  Exempts a time share developer or an affiliated entity under common ownership from registration if they are selling a time share interest in a time share plan located outside of Hawaii to an individual who currently owns a time share interest that was purchased from that developer or affiliated entity.

RELATING TO CONDOMINIUMS.

Prohibits the managing agent of a condominium from engaging in the business of a condominium hotel operator.  Requires the managing agent to make email addresses of unit owners available to all unit owners.

Grants lessees a right of first refusal contingent upon a lessor displaying an objective intent to sell or its acceptance of an offer to purchase.

Prohibits licensees with an interest in a real estate transaction involving an appraisal from improperly influencing the reporting, result, or review of a real estate appraisal.

RELATING TO RESIDENTIAL MORTGAGE PRACTICES.

Repeals the law on Mortgage Brokers and Solicitors, chapter 454, Hawaii Revised Statutes, and replaces it with a statute that provides for more specialized regulation of residential mortgage brokers, residential mortgage lenders and residential loan originators by the Division of Financial Institutions.

Makes extensive amendments to chapter 454, Hawaii Revised Statutes, relating to regulation and licensing of mortgage brokers and solicitors.

RELATING TO PROPERTY.

Requires a landlord who rents 2 or more dwelling units in an apartment building to designate the common area in each tenant's rental agreement; provided that in the absence of a designation in the rental agreement, the statutory definition shall apply.  Effective 01/01/09.

RELATING TO RENTAL SECURITY DEPOSITS.

Requires landlords to add 6% interest to security deposits returned to tenants.  Requires landlords to maintain security deposits and any interest accruing thereto in trust or separate accounts.

Email sent to individual offices or any other Senate office will not be accepted.
