RELATING TO AUTOMATED TELLER MACHINES. Requires that an agreement to operate or share an automated teller machine may not prohibit, limit, or restrict the right of the owner or operator of the automated teller machine to charge a customer transaction fee.

RELATING TO PUBLIC UTILITIES. Requires the public utilities commission to study one priority region for each county statewide to develop with input from the utilities a plan for the undergrounding of overhead utility lines for health and safety purposes. Funds for the study shall be appropriated out of the public utilities commission special fund. (SB2191 SD2)

RELATING TO MOTOR VEHICLE INSURANCE. Exempts motor vehicle insurers from being required to make available to the insured, at the insured's option, personal injury protection benefits through managed care, if there are fewer than 5 managed care providers or equivalent entities within 25 miles of the claimant. RELATING TO INSURANCE. Recognizes that a reciprocal insurer and its attorney-in-fact shall be considered as a single entity for tax purposes and not be subject to general excise taxes in order to avoid the effect of double taxation. (SB2315 SD2)

RELATING TO INSURANCE. Allows an exception for small insurers with less than five per cent of the health insurance market share to offer different types of benefits in a single unified policy. (SD1)

RELATING TO REAL ESTATE APPRAISALS. Prohibits financial institutions and mortgage brokers with an interest in a real estate transaction involving an appraisal from improperly influencing the reporting, result, or review of a real estate appraisal. (SD1)

RELATING TO MORTGAGE FORECLOSURES. Requires a mortgagee to provide the telephone number of an attorney located and licensed in Hawaii as the contact individual, and authorizes this individual to provide information to qualified callers. (SD1)

RELATING TO LEASE TO FEE CONVERSION. Grants lessees a right of first refusal contingent upon a lessor displaying an objective intent to sell or its acceptance of an offer to purchase.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
