Madam:

 

     Your Committees on Human Services and Public Housing and Education, to which was referred S.R. No. 116 entitled:

 

"SENATE RESOLUTION REQUESTING THE WILLIAM S. RICHARDSON SCHOOL OF LAW TO CONDUCT A STUDY ON LEGISLATIVE SOLUTIONS TO ADDRESS THE IMPACT OF ADULT RESIDENTIAL CARE HOME FACILITIES IN RESIDENTIAL NEIGHBORHOODS,"

 

beg leave to report as follows:

 

     The purpose of this measure is to request that the William S. Richardson School of Law conduct a study of the federal, state, and county statutes and laws relating to adult residential care home facilities, including an examination of the impact that the care home facilities have on the communities in which they are located.

 

     Testimony in support of this measure was submitted by a professor from the William S. Richardson School of Law, the Aina Haina Community Association, and six private citizens.  Testimony in opposition to this measure was submitted by the Hawaii Coalition of Caregivers.

 

     Your Committees find that moderated discussions among all interested parties would be the first step to create the public fora necessary to achieve greater balance between the needs of the senior and disabled populations served by Type II adult residential care homes (ARCH) and the rights and interests of home-owners and residents in the communities in which ARCH II facilities are located. 

 

     Your Committees have amended this measure and its title by:

 

     (1)  Changing the requested study to a request for the William S. Richardson School of Law to facilitate a discussion among all interested parties relating to the impact that ARCH II facilities have on their respective communities, and include in its report any proposed legislation concerning the creation of appropriate venues for public comment on proposed residential care facilities or on-going discussion or comment concerning facilities in operation; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity and style.

 

     As affirmed by the records of votes of the members of your Committees on Human Services and Public Housing and Education that are attached to this report, your Committees concur with the intent and purpose of S.R. No. 116, as amended herein, and recommend its adoption in the form attached hereto as S.R. No. 116, S.D. 1.
