Madam:
Your Committee on Transportation and International Affairs, to which was referred H.B. No. 3011, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO MOTOR VEHICLE REGISTRATION,"
begs leave to report as follows:
The purpose of this measure is to allow for greater flexibility in granting special motor vehicle registration under the State's administrative revocation law, by:
(1) Reducing the requirement that the applicant be completely dependent on the motor vehicle for the necessities of life by deleting the word "completely"; and
(2) Requiring the Administrative Director of the Courts to also consider the impact, including adverse effects on the respondent's household members, of refusing to grant the special motor vehicle registration.
Testimony in support of this measure was received from one individual. The Judiciary submitted comments.
Your Committee has heard that this measure would reduce the purposefully high objective standard, "completely dependent on the motor vehicle for the necessities of life," to an unspecified standard more akin to an inconvenience, particularly in families with multiple vehicles. In addition, the question was raised about the effect this change would have on the seriousness of the offense of operating a vehicle under the influence of an intoxicant.
Your Committee has considered these points, and has amended this measure accordingly, by restoring the word "completely" in section 291E-48(a)(3), Hawaii Revised Statutes.
As affirmed by the record of votes of the members of your Committee on Transportation and International Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 3011, H.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 3011, H.D. 1, S.D. 1, and be referred to the Committee on Judiciary and Labor.
