A BILL FOR AN ACT

 

 

relating to corrections.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Approximately ten Hawaii residents are housed in various prisons in the continental United States under the Interstate Corrections Compact.  Currently, there is no monitoring of conditions at these prisons or of the health and safety of the Hawaii inmates held in those prisons.

     The purposes of this Act are to:

     (1)  Require the mainland branch of the corrections division of the department of public safety to monitor and report on the conditions of Hawaii residents held in mainland prisons under the Interstate Corrections Compact; and

     (2)  Make an appropriation to allow the mainland branch to monitor and report on the conditions of these Hawaii inmates.

     SECTION 2.  The mainland branch of the corrections division of the department of public safety is directed, during its quarterly trips to the mainland, to monitor Hawaii inmates being housed under contracts in various private mainland prisons, to include the monitoring of Hawaii residents being imprisoned in any mainland prison under the Interstate Corrections Compact.  The monitor reports of these latter inmates and of inmates at the other contracted private prisons shall be minimally redacted to exclude a particular prisoner's name and other sensitive and protected information.  All monitor reports shall comply with and be available for public inspection pursuant to chapter 92F, Hawaii Revised Statutes.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $        , or so much thereof as may be necessary for fiscal year 2007-2008, and the same sum, or so much thereof as may be necessary for fiscal year 2008-2009, for the purpose of allowing the mainland branch of the corrections division of the department of public safety to monitor and report on Hawaii inmates held in mainland prisons under the Interstate Corrections Compact.

     The sums appropriated shall be expended by the department of public safety for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2007.
