A BILL FOR AN ACT
relating to lands controlled by the state.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 27, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§27- Sale of lands under the control of state departments and agencies; legislative approval required. (a) No sale of state lands controlled by any state department or agency shall be made without the approval of the legislature by at least two-thirds majority vote of the members to which each house is entitled in any regular or special session following the date of approval in principle of a sale by the state department or agency.
(b) The state department or agency shall submit for introduction to the legislature a concurrent resolution for review of action on any sale of state land controlled by the state department or agency, wherein the deed for the land shall be executed by the parties together with the following information:
(1) The location and area of the parcel of land to be sold;
(2) The value of the land to be sold;
(3) The names of all appraisers performing appraisals of the land to be sold;
(4) The date of the appraisal valuation;
(5) The purpose for which the land is being sold; and
(6) A detailed summary of any development plans for the land to be sold.
(c) If the legislature fails to approve the resolution to authorize the sale of state land under the control of the state department or agency as provided in subsection (a), the transaction shall not be executed by the state department or agency."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
