A BILL FOR AN ACT


 

 

RELATING TO NOISE ABATEMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that noise abatement laws have not been effectively enforced.  As the State's population increases, especially in congested urban areas, noise abatement has become an issue of critical concern to many residents and visitors.

     The purpose of this Act is to respond to these concerns by appropriating funds to establish county noise abatement programs patterned after the "Click It or Ticket" seat belt program.  A concerted county effort will provide the needed organization to enforce noise abatement county ordinances such as section 41‑31.1, Revised Ordinances of Honolulu and laws under chapter 342F, Hawaii Revised Statutes, and sections 291-22, 291-23, 291‑24, and 291-24.5, Hawaii Revised Statutes.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $        , or so much thereof as may be necessary for fiscal year 2007-2008, and the same sum, or so much thereof as may be necessary for fiscal year 2008-2009, to provide incentives to the counties to develop noise abatement programs to enforce noise abatement laws and ordinances.  The appropriation shall be made as follows:

     County of Hawaii             $       

     County of Kauai              $       

     County of Maui               $       

     City and county of Honolulu  $_______

          Total                   $       .

     The sums appropriated shall constitute the State's share of the cost of mandated programs under article VIII, section 5 of the state constitution.

     SECTION 3.  The sums appropriated shall be expended by each respective county for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2007.
