A BILL FOR AN ACT

RELATING TO RECYCLING.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  The legislature finds that recycling prevents useful material resources from being wasted, reduces the consumption of raw materials, and reduces energy usage, and hence greenhouse gas emissions, as compared to production using virgin materials.  Recycling is a key component of waste management and is the third component of the waste hierarchy, to reduce, to reuse, and to recycle.

     In establishing its policy that the State should lead by example, the legislature enacted, Act 96, Session Laws of Hawaii 2006, relating to energy.  The legislature mandated the incorporation of waste minimization and pollution prevention principles such as reducing, reusing, and recycling as a standard operating practice in programs, including programs for waste management in construction and demolition projects and office paper and packaging recycling programs to promote energy efficiency and environmental standards for state facilities.

     The purpose of this Act is to include the use of recycling receptacles as an additional element of state energy management for which the public-private policy advisory committee under chapter 196, Hawaii Revised Statutes, shall provide input.

     SECTION 2.  Section 196-18, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The committee shall provide input on state energy management, including how to:

     (1)  Improve the use of energy-savings contracts;

     (2)  Improve procurement of ENERGY STAR and other energy efficient products;

     (3)  Improve building design;

     (4)  Reduce energy use;

     (5)  Enhance applications of efficient and renewable energy technologies at state facilities;

     (6)  Establish benchmarks and evaluate the State's progress in incorporating energy efficiency and conservation for state facilities, vehicles, and equipment;

     (7)  Make recommendations on how and when to conduct periodic energy audits; [and]

     (8)  Make recommendations to the legislature no later than twenty days prior to the convening of each regular session, starting with the 2008 regular session, regarding policy or other statutory changes to carry out the purposes of this chapter[.]; and

(9) Facilitate and improve state recycling efforts by strategic placement of segregated recycling receptacles in all state facilities."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2015.
