A BILL FOR AN ACT

 

 

relating to the procurement code.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to part X to be appropriately designated and to read as follows:

     "§103D-    Experiential learning opportunity; repair and maintenance of public schools.  (a)  A portion of a competitive sealed bid under section 103D-302, or portion of a competitive sealed proposal under section 103D-303, may include an alternative bid or proposal, as applicable, for an experiential learning opportunity to consist of providing on-the-job learning instruction to students of the particular public school in which the repair and maintenance is being performed by the contractor; provided that students enrolled in the construction academies under chapter 304A may also be provided with an experiential learning opportunity.  A bid under section 103D-302 containing an alternative bid for an experiential learning opportunity shall be given greater favorable consideration in the evaluation process.  A proposal under section 103D-303 containing an alternative proposal for an experiential learning opportunity shall be given greater favorable consideration in the award process.

     (b)  As used in this section:

     "Experiential learning opportunity" means any learning opportunity that allows the learner to obtain information and learn practical skills that are necessary to perform in the workplace and provides significant experiences with real outcomes that create measurable learning achievements through participation and reflection.

     "Given greater favorable consideration" means that a bid or proposal is given an advantage over a bid or proposal that does not include a learning opportunity, in the consideration of the entire bid or proposal, including but not limited to, price and quality.

     "Repair and maintenance" means the repair, replacement, or maintenance of the exterior or interior, including the fixtures, furnishings, and equipment of any state public education facility that is required:

     (1)  For the facility to be used for the next twenty-five years;

     (2)  For health or safety reasons;

     (3)  To comply with legal mandates;

     (4)  To comply with current building codes; or

     (5)  For preventive maintenance reasons."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
