Provides that no labor organization is required to provide legal defense or legal representation to a member accused of a crime under circumstances in which the labor organization believes in good faith that there is reasonable cause to believe that the member is guilty and that legal representation would be inappropriate.

A BILL FOR AN ACT

 

 

Relating to labor.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 377, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§377-    Labor organization representation.  Notwithstanding any law to the contrary, no labor organization shall be required by law to provide legal defense or legal representation to any labor organization member accused of a crime under circumstances in which the labor organization believes in good faith that there is reasonable cause to believe that the member is guilty as charged and in which the labor organization believes such legal defense or legal representation to be inappropriate."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
