A BILL FOR AN ACT

RELATING TO DRUG TESTING.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-__ Drug testing. All recipients of general assistance, food stamps, or temporary assistance for needy families administered by the department are subject to random drug testing in order to retain eligibility.  The department may terminate benefits for any recipient who refuses to consent to a random drug test, or to any recipient who fails a drug test.  The department shall adopt rules as necessary to effectuate this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
