A BILL FOR AN ACT

 

 

RELATING TO DRUG TESTING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-__  Drug testing.  All recipients or clients who receive assistance or services administered by the Med-Quest Division are subject to random drug testing in order to retain eligibility.  The department may terminate benefits for any recipient or client who refuses to consent to a random drug test.  Any recipient or client who fails a drug test shall be required to attend a substance abuse rehabilitation program approved by the department in order to retain eligibility.  Failure to attend an approved substance abuse rehabilitation program by the recipient or client shall result in termination of Med-Quest benefits by the department.  The department shall adopt rules as necessary to effectuate this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
