A BILL FOR AN ACT

RELATING TO CRIMES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§711-   Human consumption of a cat, dog, or horse. (1)  Unless otherwise authorized by law, a person commits the offense of human consumption of a cat, dog, or horse, if the person intentionally or knowingly consumes a cat, dog, or horse.

(2)  Nothing in this section is intended to affect any civil remedies available for a violation of this section.

(3)  The human consumption of a cat, dog, or horse is a misdemeanor."

     SECTION 2.  Section 711-1100, Hawaii Revised Statutes, is amended by amending the definition of "pet animal" to read as follows:

     ""Pet animal" means a dog, cat, horse, domesticated rabbit, guinea pig, domesticated pig, or caged [birds] bird (passeriformes, piciformes, and psittaciformes only) [so long as]; provided that the domesticated rabbit, guinea pig, domesticated pig, or caged bird is not bred for consumption."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
