A BILL FOR AN ACT
RELATING TO incandescent light bulbs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that there is a growing awareness of the economic, energy security, and environmental benefits of energy efficient lighting. Incandescent lighting wastes energy in two ways: ninety-five per cent of the energy generated is given off as heat, with only five per cent being emitted as light, and with the heat produced, the air conditioning systems must work harder to cool the room. Fluorescent and light-emitting diode (LED) lighting produce more light on less energy, thereby conserving limited resources and reducing dependence on fossil fuel. With the cost of imported oil rising and expected to climb well over $100 a barrel in the near future, Hawaii residents benefit by making the transition to energy efficient products wherever possible.
SECTION 2. The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:
"CHAPTER
PROHIBITION OF INCANDESCENT LAMP SALES
§ -1 Definitions. As used in this chapter:
"General service incandescent lamp":
(1) Means a standard incandescent or halogen type lamp that is intended for general service applications and has all of the following:
(A) A medium screw base;
(B) A wattage rating no less than twenty-five watts and no greater than one hundred fifty watts;
(C) An A-15, A-19, A-21, A-23, A-25, PS-25, PS-30, BT-14.5, BT-15, CP-19, TB-19, CA-22, or equivalent shape as defined in the American National Standard Institute C78.20-2003; and
(D) A bulb finish of frosted, clear, or soft white type; and
(2) Does not include an appliance lamp, black light lamp, bug lamp, colored lamp, enhanced spectrum lamp, infrared lamp, left-hand tread lamp, marine lamp, marine signal service lamp, mine service lamp, plant light, reflector lamp, rough service lamp, shatter resistant lamp, sign service lamp, silver bowl lamp, showcase lamp, three-way lamp, traffic signal lamp, or vibration service or vibration resistant lamp.
§ -2 Restriction on distributing in commerce. After December 31, 2008, a general service incandescent lamp shall not be sold in the State."
SECTION 3. Within thirty days after the enactment of this Act, the director of health shall undertake a public education and awareness campaign to inform businesses and homeowners about the proper handling and disposal of compact fluorescent light bulbs and the small amounts of mercury contained therein. Consistent with the efforts of the United States Environmental Protection Agency, the director of health shall work with county solid waste agencies to develop instructions for the proper disposal and recycling of compact fluorescent light bulbs in the State. The director shall utilize both electronic and print media and any other methods deemed appropriate to conduct this public education campaign.
SECTION 4. This Act shall take effect upon its approval.
