A BILL FOR AN ACT
RELATING TO THE TRANSIENT ACCOMMODATIONS TAX.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 237D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§237D‑ Tax credits for hotels furnishing room blocks for Hawaii convention center bookings. (a) A hotel, as referenced in the definition of "transient accommodations" under section 237D-2, that provides accommodations for not less
than rooms in connection with an event reservation at the convention center facility, as defined in section 201B-1, may claim a tax credit under this section against the tax imposed under section 237D-2, if the hotel room is offered at a discount rate of per cent of the average hotel room rate as calculated by the Hawaii tourism authority at the time of the event.
(b) The director of taxation shall prepare such forms as may be necessary to claim a credit under this section, may require proof of the claim for the tax credit, and may adopt rules pursuant to chapter 91.
(c) Claims for the tax credit under this section, including any amended claims, shall be filed with the annual return under section 237D-7."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act, upon its approval, shall apply to taxable years beginning after December 31, 2007.
