A BILL FOR AN ACT

 

 

relating to medical records.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 622-57, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  If an attorney for a patient asks a health care provider for copies of the patient's medical records and presents a proper authorization from the patient for the release of the information, the health care provider shall provide the attorney with complete and accurate copies of the records [shall be given to the attorney] within a reasonable time not to exceed ten working days[.] or permit the copying, scanning, or printing of the medical records at the health care provider's premises within ten working days at a charge not to exceed $25."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
