A BILL FOR AN ACT

 

 

relating to minors.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 356D-127, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The provider agency operating and managing a homeless facility, or any other program for the homeless authorized by this part, or the authority operating and managing its own homeless facility, shall be responsible for determining if an applicant is eligible for shelter or other services at the homeless facility or through any other program for the homeless, pursuant to standards and criteria established by rule.  The provider agency shall also be responsible for determining if a minor is eligible for shelter or other services at the homeless facility or through any other programs for the homeless; provided that:

     (1)  The minor has sufficient mental capacity to understand the nature and consequence of receiving shelter or other services at the homeless facility;

     (2)  The shelter and services are for the minor's benefit; and

     (3)  The minor is not under a parent's, custodian's, or legal guardian's care, supervision or control, or obtaining appropriate legal consent is not practical."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
