A BILL FOR AN ACT

 

 

relating to education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Act 246, Session Laws of Hawaii 2006, is amended by adding a new section to read as follows:

     "SECTION 6A.  There is appropriated out of the state educational facilities special fund the sum of $90,000,000 or so much thereof as may be necessary for fiscal year 2006-2007 for the renovation of classrooms statewide in the department of education.

     The appropriation made by this section shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2010, shall lapse as of that date.

     The sum appropriated shall be expended by the department of education for the purposes of this section."

     SECTION 2.  Act 246, Session Laws of Hawaii 2006, is amended by amending sections 4 and 5 to read as follows:

     "SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of [$160,000,000] $70,000,000 or so much thereof as may be necessary for fiscal year 2006-2007 for the renovation of classrooms statewide in the department of education.

     The appropriation made by this section shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

     The sum appropriated shall be expended by the department of education for the purposes of this section.

     SECTION 5.  The director of finance is authorized to issue general obligation bonds in the sum of [$40,000,000] $130,000,000 or so much thereof as may be necessary, and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2006-2007 for repair and maintenance of department of education school facilities[.], including the renovation of classrooms.

     The appropriation made by this section shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, [2008,] 2010, shall lapse as of that date.

     The appropriation made by this section shall be deposited in the state educational facilities special fund.

     The sum appropriated shall be expended by the department of education for the purposes of this section."

     SECTION 3.  Act 213, Session Laws of Hawaii 2007, is amended by amending section 125, part G, item G-4 to read as follows:

"4.  LUMP SUM CIP - SCHOOL BUILDING IMPROVEMENTS, STATEWIDE

       DESIGN AND CONSTRUCTION FOR THE IMPROVEMENTS OF PUBLIC SCHOOL FACILITIES, STATEWIDE.  MAY INCLUDE PROJECT MANAGEMENT AND CONSTRUCTION MANAGEMENT SERVICES, ROOFING, AIR CONDITIONING, PAINTING, PLUMBING, AND OTHER REPAIRS AND IMPROVEMENTS TO PUBLIC SCHOOL FACILITIES.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.


     SECTION 5.  This Act shall take effect upon its approval.
