A BILL FOR AN ACT

 

 

RELATING TO PAPER WASTE REDUCTION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that telephone directories, such as the yellow pages and white pages, which are being distributed to consumers, often go unclaimed, causing litter and an unnecessary use of resources.  In an effort to reduce paper waste, directories should be distributed only to those consumers who have specifically requested them.

     SECTION 2.  (a)  There is established the telephone directory request program that shall provide Hawaii consumers with the option to receive telephone directories at their request, thereby reducing paper waste throughout the State.

     (b)  Notwithstanding any law to the contrary, beginning January 1, 2010, any company that issues telephone directories, yellow pages, or white pages shall issue telephone directories to a customer only upon receipt of a telephone directory request form provided by the company and signed by the customer prior to distribution.  The telephone directory request forms are valid for one year and shall be renewed in writing annually.  Any company that distributes a directory without a signed affirmative request may be fined up to fifty dollars for each violation.

     (c)  Notwithstanding any law to the contrary, beginning January 1, 2010, the public utilities commission shall require telephone utilities, which are subject to the jurisdiction of the commission, to issue telephone directory request forms to all of its customers served by that directory, that allows the customer to affirmatively request the directory prior to distribution.  Any utility that distributes a directory without the customer's affirmative request may be fined up to fifty dollars for each violation.

     SECTION 3.  This Act shall take effect upon its approval, and shall be repealed on January 1, 2015.
