A BILL FOR AN ACT

 

 

RELATING TO INSURANCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to article 10C to be appropriately designated and to read as follows:

     "§431:10C-    Driver education and behind-the-wheel driver training program; rate reduction.  (a)  An insurer may implement a rate reduction for each policy issued if the insured has satisfactorily completed a driver education and behind-the-wheel driver training program as certified under section 286-108.4; provided that:

     (1)  The insured has no traffic violations; and

     (2)  The rate reduction is not in violation of section 431:10C-207.

     (b)  The reduced rate shall be valid for three years following the successful completion of the program or a refresher course."

     SECTION 2.  Section 286-108.4, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§286-108.4  Driver education and behind-the-wheel driver training program.[]]  The director [of transportation] is directed to establish and certify a statewide driver education program and behind-the-wheel driver training program, to include the number of course hours, curriculum, and certification of teachers and third-party examiners[.], and an optional driver education and behind-the-wheel driver training program for purposes of section 431:10C-   .  The director [of transportation] is also directed to set a cost for the programs to enable the programs to be self-sufficient.  The director [of transportation] shall adopt rules pursuant to chapter 91 necessary for the purposes of this [[]section[]]."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2007.
