A BILL FOR AN ACT
MAKING AN APPROPRIATION FOR A CAPITAL IMPROVEMENT PROJECT FOR Mānele SMALL BOAT HARBOR ON Lāna‘i.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature find that the Mānele small boat harbor on Lāna‘i needs reconstruction of deteriorating loading docks and related appurtenances. The main loading dock has been out of service for approximately three years due to potential hazards arising from deterioration. Also, the adjacent loading dock is badly deteriorated and may pose a safety hazard in the near future. The boat ramp is the only one on the island of Lāna‘i for use by recreational boaters.
The legislature further finds that if repairs are deferred, boaters will continue to be unable to use the loading docks to safely launch their vessels. Deferral will likely result in a more expensive project to undertake in the future.
The purpose of this Act is to make an appropriation for a capital improvement project to reconstruct the loading docks located at the Mānele small boat harbor on Lāna‘i to provide a safe and usable facility for boaters.
SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $250,000 or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2008-2009 for the purpose of design and reconstruction of the Mānele small boat harbor on Lāna‘i.
SECTION 3. The sum appropriated for the respective capital project set forth in section 2 shall be expended by the department of transportation for the purposes of this Act.
SECTION 4. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2010, shall lapse as of that date.
SECTION 5. This Act shall take effect on July 1, 2008.
