A BILL FOR AN ACT

 

 

RELATING TO TRAFFIC VIOLATIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§291‑    Mopeds; modification to increase speed; penalty.  (a)  No person shall modify, alter, or install equipment on a moped to increase the speed of the moped above the limit of the moped as manufactured.

     (b)  This section shall not apply to mopeds used by law enforcement agencies.

     (c)  The penalty for violation of this section shall be a fine assessed upon the:

     (1)  Person who modifies, alters, or installs the equipment; and

     (2)  Registered owner of the moped who caused the modification, alteration, or installation of equipment, without regard to whether the violation is for the same or another moped registered to the registered owner.

     A fine of $100 shall be assessed for the first violation; provided that the penalty for a subsequent violation shall be:

     (1)  $250 for the second violation;

     (2)  $375 for the third violation;

     (3)  $500 for a fourth violation; and

     (4)  For the fifth and subsequent violations, a fine of $1,000 and up to one year of incarceration for each violation."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
