A BILL FOR AN ACT

 

 

RELATING TO REAL PROPERTY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to amend the definition of "familial status" in section 515-2, Hawaii Revised Statutes, to specify that a non-parent individual cohabiting with any minor children must have the written consent of the child's parent in order to qualify for "familial status" under the state housing laws.

     SECTION 2.  Section 515-2, Hawaii Revised Statutes, is amended by amending the definition of "familial status" to read as follows:

     ""Familial status" means the status of:  a parent having legal custody of and [domiciled] cohabiting with a minor child or children, a person who is [domiciled] cohabiting with a minor child or children [and who has] pursuant to the express written [or unwritten] permission [from] of the legal parent, a person who is pregnant, or [any] a person cohabiting with a minor child or children and who is in the process of securing the legal custody of [a minor] the child or children."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
