Description:

Codifies the designation of the Nu‘uanu ahupua‘a area in Honolulu respectively between Kalihi and Piikoi streets, and Pali lookout and the Pacific ocean as the Hawaii capital cultural heritage area. Appropriates funds for the arts and culture development branch of the department of business, tourism, and economic development, to plan and implement programs and projects that recognize, preserve, stimulate, and celebrate the significance of the Hawaii capital cultural heritage area and its exceptional trees. (SD1)

SECTION 1. On October 2, 2003, Governor Linda Lingle and former Mayor Jeremy Harris of the city and county of Honolulu signed a joint proclamation establishing the Hawaii capital cultural district. The designated area lies between Kalihi and Piikoi streets, and Beretania street and the Pacific ocean. The legislature passed House concurrent resolution no. 50, H.D. 1, S.D. 1 (2004) designating the same area as the Hawaii capital cultural district, as well.

The Hawaii Capital Cultural District Coalition, a nonprofit organization, is a broad‑based partnership of arts and cultural organizations, businesses, public agencies, and community members who share a vision of a vibrant and active central Honolulu characterized by Hawaii's unique and diverse heritage, cultures, and arts, and who look to become recognized as a national heritage area by the national park service of the United States Department of the Interior. The department of business, economic development, and tourism is an active participant in the coalition. Among the responsibilities of the arts and culture development branch of the department of business, economic development, and tourism is stimulating, guiding, and promoting culture and the arts as a creative economy and vibrant and sustainable sector of Hawaii's economy throughout the State.

The purpose of this Act is to:

(1) Codify the designation of the Nu‘uanu ahupua‘a area bounded respectively by Kalihi and Piikoi streets, and the Pali lookout and the Pacific ocean as the Hawaii capital cultural heritage area; and

(2) Appropriate funds for the arts and culture development branch of the department of business, economic development, and tourism to plan and implement programs and projects that recognize, preserve, and celebrate the significance of the Hawaii capital cultural district and its exceptional trees, recently named the Hawaii capital cultural heritage area, to the heritage, culture, and arts of Hawaii.

SECTION 2. Chapter 201, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§201‑ Hawaii capital cultural heritage area. (a) There is established a Hawaii capital cultural heritage area.

(b) The Hawaii capital cultural heritage area shall be the Nu‘uanu ahupua‘a area in Honolulu, Oahu bounded respectively by Kalihi street, Piikoi street, Pali lookout, and the Pacific ocean.

(c) The arts and culture development branch of the department of business, economic development, and tourism shall encourage residents, government agencies, nonprofit organizations, and private partners to collaboratively plan and implement programs and projects that recognize, preserve, stimulate, and celebrate the significance of the Hawaii capital cultural heritage area and its exceptional trees to the heritage, culture, and arts of Hawaii."

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,000,000 or so much thereof as may be necessary for fiscal year 2008-2009 for the arts and culture development branch of the department of business, economic development, and tourism to plan and implement programs and projects that recognize, preserve, stimulate, and celebrate the significance of the Hawaii capital cultural heritage area and its exceptional trees to the heritage, culture, and arts of Hawaii, including efforts towards becoming recognized as a national heritage area by the national park service of the United State Department of the Interior.

The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval; provided that section 3 shall take effect on July 1, 2008.
