A BILL FOR AN ACT
RELATING TO LEGACY LANDS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to make an appropriation for the board of land and natural resources to enter into negotiations and to acquire land along the Ka ‘Iwi coast which is in imminent danger of being developed. The acquired land is to be held as resource value lands, also known as legacy lands. The funds necessary for this acquisition shall come from the land conservation fund.
SECTION 2. Notwithstanding the application and acquisition provisions set forth in subsections 173A-5(h) and (i), Hawaii Revised Statutes, the board of land and natural resources shall enter into negotiations to acquire property along the Ka ‘Iwi coast, which is in imminent danger of being developed. The board shall exercise its authority pursuant to section 173A‑4, Hawaii Revised Statutes, and utilize other funds at its discretion in addition to those funds available under chapter 173A, Hawaii Revised Statutes, to obtain the Ka ‘Iwi coast lands; provided that funds received from the land conservation fund pursuant to this Act shall not effect the availability and amount of subsequent grants made from the land conservation fund for other purposes.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2008-2009 for deposit into the land conservation fund.
SECTION 4. There is appropriated out of the land conservation fund the sum of $ or so much thereof as may be necessary for fiscal year 2008-2009 to acquire property along the Ka ‘Iwi coast.
The sum appropriated shall be expended by the board of land and natural resources by December 31, 2009 from the land conservation fund for the purposes of this Act. If the sum appropriated is not expended for the purposes of this Act by December 31, 2009, the moneys shall be used by the legacy land conservation commission for purposes consistent with the land conservation fund.
SECTION 5. The land acquired pursuant to this Act shall be held as resource value land, pursuant to the provisions of chapter 173A, Hawaii Revised Statutes.
SECTION 6. This Act shall take effect on July 1, 2008.
