A BILL FOR AN ACT
relating to speeding.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 291C-105, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) [No person shall drive] A
person commits the offense of excessive speeding if:
(1) The person drives a motor vehicle at a speed exceeding:
[(1)] (A) The applicable state or
county speed limit by thirty miles per hour or more; or
[(2)] (B) Eighty miles per hour or more
irrespective of the applicable state or county speed limit[.]; or
(2) The person:
(A) Drives a motor vehicle at a speed exceeding the applicable state or county speed limit; and
(B) Has been determined to have committed, within the twelve months preceding the violation under this section, three or more offenses under this part."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
