A BILL FOR AN ACT
RELATING TO MOTOR SPORTS COMPLEX.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The Hawaii Raceway Park closed in 2006, leaving motor sports racing enthusiasts without a venue to perform and enjoy their hobby. Motor sports are immensely popular on Oahu, and the closure of the raceway deprived Oahu residents of a place where racing is legal and controlled. In addition, a raceway would provide an alternative to illegal street racing and provide a facility for pursuit training for law enforcement officials.
The purpose of this Act is to allow the department of land and natural resources to exercise eminent domain proceedings to condemn the land formerly used for the Hawaii Raceway Park, or in the alternative, to arrange for an exchange of land with the owner.
SECTION 2. The department of land and natural resources may exercise eminent domain to condemn certain parcels of land (TMK: 9-1-075:044 of 7.066 acres, and TMK: 9-1-075:050 of 58.11 acres) located in Kapolei, Hawaii, for public use as a public raceway park. In lieu of condemnation, the department of land and natural resources may arrange for an exchange of land or acquire said lands by negotiation.
SECTION 3. After acquisition of lands described in section 2 of this Act, the department of land and natural resources shall cause the lands to be reclassified and rezoned for use as a raceway park facility for motor sport events and activities, among other appropriate related uses.
The department of land and natural resources may cause said lands to be developed by a private developer, as provided by law, for the purpose of construction and operation of a raceway park facility for motor sports.
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2008-2009 for eminent domain proceedings to condemn parcels of land as described under section 2 of this Act, or to otherwise acquire said land by negotiation.
The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.
SECTION 5. This Act shall take effect on July 1, 2008.
