A BILL FOR AN ACT

 

 

making an appropriation for wells.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Act 178, Session Laws of Hawaii 2005, appropriated $6,000,000 for exploratory and production wells in the vicinity of Hawaiian Ocean View Estates in the county of Hawaii.  While diligent efforts have been made to encumber these funds prior to lapsing on June 30, 2008, unforeseen problems may make that impossible.

     This Act is intended to better assure construction of the wells by reappropriating the funds authorized in Act 178, Session Laws of Hawaii 2005.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $6,000,000 or so much thereof as may be necessary for fiscal year 2008-2009 for plans, land acquisition, design and construction for exploratory and production wells in Kau, Hawaii; provided that, if moneys appropriated pursuant to Act 178, Session Laws of Hawaii 2005, are encumbered prior to the effective date of this Act, then a portion of the moneys appropriated under this Act that are equal to the amount encumbered under Act 178, Session Laws of Hawaii 2005, shall not be released and shall immediately lapse to the credit of the general fund.

     SECTION 3.  This Act shall take effect on July 1, 2008.
