A BILL FOR AN ACT
RELATING TO THE AFTER-SCHOOL PLUS PROGRAM REVOLVING FUND.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the purpose of the after-school plus program revolving fund is to ensure that the program participant fees are used to support the program. The legislature further finds that the program is also supported by general fund appropriations and funds from the department of human services for child care for eligible low-income children.
The purpose of this Act is to require that the funds deposited into the after-school plus program revolving fund are only those funds that are collected as fees or charges for participation in the after-school plus program and interest earned on the revolving fund deposits and investments.
SECTION 2. Section 302A-1149.5, Hawaii Revised Statutes, is amended to read as follows:
"[[]§302A-1149.5[]]
After-school plus program revolving fund. (a) There is established in
the state treasury the after-school plus program revolving fund to be
administered by the department.
(b) The after-school plus program revolving
fund shall consist of[:
(1) Fees] fees and charges
collected by the department for administering and operating the after-school
plus program[, and the provision of program services;
(2) Legislative appropriations;
(3) All] and all interest earned
on the deposit or investment of moneys in the after-school plus program
revolving fund[; and
(4) Any other moneys made available to the
after-school plus program revolving fund from other sources].
(c) The department may establish appropriate
fees and other charges to be assessed to each participant for [the cost of
administering and operating] the after-school plus program. The revenues
from those fees and charges shall be deposited into the revolving fund to be
used [to pay the costs of administering and operating] for the
program."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2008.
