A BILL FOR AN ACT
relating to disaster preparedness.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that preparedness is the best way to help prevent loss of life in the event of a tsunami. The legislature also finds that there exists an immediate need to complete updating of tsunami inundation maps to take into account development that has taken place during the past several years to include provision for evacuation to high-rise buildings as well as overland evacuation routes.
SECTION 2. There is appropriated out of general revenues of the State of Hawaii the sum of $5,000,000, or so much thereof as may be necessary for fiscal year 2007-2008, to expedite the project to update tsunami inundation maps of the Hawaiian islands.
SECTION 3. The sum appropriated shall be expended by the Department of Defense for the purposes of this Act.
SECTION 4. Chapter 107, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§107- Design and construction of non-maritime related public and non-public buildings and facilities in tsunami inundation zones. (a) The department of accounting and general services in coordination with The State Department of Defense Civil Defense Division shall adopt rules pursuant to chapter 91 to provide a building code for state-owned buildings, including but not limited to, non-maritime public and non-public buildings and facilities in tsunami inundation zones.
(b) The State Department of Defense Civil Defense Division shall establish areas of expected tsunami inundation based on scientific evidence to include computer modeling and geologic data.
(c) The provisions of this section do not apply to water dependent and water-related facilities, including but not limited to docks, wharves, piers, and marinas. For the purpose of this section "Tsunami Inundation Zones" means an area of expected tsunami inundation, based on scientific evidence that may include geologic field data and tsunami modeling.
(d) Certain structures that are vulnerable to tsunamis are as follows:
(1) public facility includes, but is not limited to:
(A) hospitals and other medical facilities;
(B) fire and police stations;
(C) emergency response vehicle garages;
(D) school, college, university buildings;
(E) jail and detention facilities;
(F) public assembly structures
(2) non-public facility includes, but is not limited to:
(A) single family houses;
(B) multi-family houses and buildings;
(C) commercial, office, and industrial buildings
(3) hazardous material facility.
SECTION 5. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2007.
