A BILL FOR AN ACT


 

 

RELATING TO THE CIVIL SERVICE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 76-45, Hawaii Revised Statutes, is amended to read as follows:

     "§76-45  Suspension.  [An] No appointing authority [may], for disciplinary purposes, may suspend any employee without pay or place an employee on leave without pay pending an investigation[.] unless the employee is given notice of the suspension and an opportunity to be heard.  Suspensions and leaves without pay pending an investigation shall be in accordance with procedures negotiated under chapter 89 or established under chapter 89C, as applicable."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
