A BILL FOR AN ACT

 

 

RELATING TO KALAELOA HARBOR.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that users of ports on Oahu are increasingly confronted with limitations on the availability of berth and terminal resources, as with ports on all islands.  Harbors users, including members of the Hawaii Harbor Users Group, understand well the critical role ports play in the economic life of the islands.  Port facilities greatly influence the success and commercial well-being of the State.

     The Hawaii Harbor Users Group was formed by private enterprise to advise the department of transportation on planning and development of port facilities.  The group submitted its report in February 2006, making recommendations on long-term strategic projects, medium term projects required to meet the needs in the next two to four years, and short term projects on a smaller scale to provide immediate relief of pressing constraints.

     The legislature finds that the Kalaeloa harbor holds great potential for the relief of port congestion at Honolulu harbor, as well as for the economic development of the Ewa plain.

     The purpose of this Act is to establish a Kalaeloa harbor users group, similar to the Hawaii Harbor Users Group.

     SECTION 2.  (a)  There is established the Kalaeloa harbor users group, to be under the department of transportation for administrative purposes.  The Kalaeloa harbor users group shall be a non-governmental, private entity exempt from chapter 76 or 92, Hawaii Revised Statutes, and section 26-34, Hawaii Revised Statutes.

     (b)  Members shall be representatives of the following companies:  AES Kalaeloa Ventures LLC; Hawaiian Cement; Sause Brothers Inc.; Tesoro Hawaii, Inc.; Aloha Petroleum; Smith Maritime; The Gas Co.; Healy Tibbets Brothers, Inc.; Marisco Ltd.; Transmarine Navigation; Waldron Norton Lily; Daehan Shipping Agency; Norko Marine; Phoenician LLC; Ko Olina Marina; Schnitzel Steel; Grace Pacific; Ameron; McCabe Hamilton Renny; and Hawaii Stevedores.  Additional stakeholders at Kalaeloa harbor may be selected by the group.

     (c)  The members shall serve voluntarily without compensation and shall not be reimbursed for expenses.  The department of transportation shall provide a meeting place for the members, if necessary, and assist the Kalaeloa harbor users group to the same extent as the Hawaii Harbors Users Group.

     (d)  The Kalaeloa harbor users group shall study and make recommendations on the same issues as the Hawaii Harbor Users Group, but specifically for Kalaeloa harbor.  In addition, the study shall include the use of Kalaeloa harbor as an alternate harbor to Honolulu harbor, and other relevant matters brought to the attention of the Kalaeloa harbor users group.

     (e)  The Kalaeloa harbor users group shall submit an interim report to the department of transportation and the legislature no later than twenty days prior to the convening of the regular session of 2008, and a final report no later than twenty days prior to the convening of the regular session of 2009.  More reports thereafter may be submitted as the Kalaeloa harbor users group deems advisable.

     (f)  The Kalaeloa harbor users group may exist for as long as it deems necessary to accomplish its work.

     SECTION 3.  This Act shall take effect upon its approval.
