Amends the offense of inattention to driving to specify negligence as the requisite state of mind.  Amends penalties to be consistent with those of reckless driving.  Gives court discretion to require defendant to comply with financial responsibility requirements.

A BILL FOR AN ACT

 

 

relating to driving.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 291-12, Hawaii Revised Statutes, is amended to read as follows:

     "§291-12  [Inattention to] Negligent driving.  (a)  Whoever negligently operates any vehicle [without due care or in a manner as to cause] or who negligently causes a collision with, or injury or damage to, as the case may be, any person, vehicle or other property shall be fined not more than $500 or imprisoned not more than [thirty] fifteen days, or both.

     (b)  For purposes of this section, "negligently" has the same meaning as used in section 702-206(4).

     (c)  Unless required by the court, in its discretion, a person convicted under this section shall not be required to provide proof of financial responsibility pursuant to section 287-20."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

 

     SECTION 3.  This Act shall take effect upon its approval.
