A BILL FOR AN ACT

 

 

RELATING TO BRIBERY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 710, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

     "§710-    Failure to disclose bribery.  (1)  A person commits the offense of failure to disclose bribery, as the term "bribery" is used in section 710-1040, if, as applicable:

    (a)   A public servant fails to disclose any act that constitutes bribery under section 710-1040(1)(a); or

    (b)   Any person who, on behalf of the person's self, or on behalf of any other person or entity doing business with or seeking to do business with, or in the preceding year has done business with or has sought to do business with, a state or county department or agency, fails to promptly disclose a solicitation, acceptance, or agreement to accept, directly or indirectly, any pecuniary benefit conferred by that person, which constitutes bribery under section 710‑1040(1)(b).

The disclosure shall be made to an appropriate law enforcement agency, including the county prosecutor, county police chief, state attorney general, or a federal law enforcement agency with jurisdiction over the matter.

     (2)  Disclosure shall include a complete and accurate description of all relevant information known to the person making the disclosure.  The law enforcement agency receiving the disclosure shall maintain a written record of the disclosure.

     (3)  Failure to disclose bribery under subsection (1)(a) is a class B felony.  Failure to disclose bribery under subsection (1)(b) is a class C felony."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
