A BILL FOR AN ACT
RELATING TO TEACHING.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to help assure the quality of public education over the long-term by directing more resources to schools not presently making adequate yearly progress to satisfy that requirement. The Act provides incentives to encourage national board certificated teachers to apply their nationally recognized skills to helping those public schools that have not made adequate yearly progress meet those requirements.
SECTION 2. Subpart C, of part III, of chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§302A- Incentives to national board certificated teachers to assist public schools achieve adequate yearly progress. (a) Every teacher who maintains a current national board certification, and teaches and mentors other teachers at a public school, including a public charter school, that has not satisfied the State's adequate yearly progress requirement for at least three years shall be paid a $10,000 bonus at the end of each of those three school years. The teacher shall also be entitled to return to the teacher’s former school after those three years, without suffering any loss of status, seniority, or other benefit. All bonuses paid under this subsection shall constitute a debt due and owing to the State, if the three year commitment is not satisfied.
(b) The benefits conferred by this section shall not be available to retired teacher rehired pursuant to the section added to chapter 302A by section 2 of Act 286, Session Laws of Hawaii 2006."
SECTION 3. Chapter 302B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"302B- Incentives for national certificated teachers to assist in achieving adequate yearly progress, and for certificated teachers to return to the classroom. All of the incentives conferred upon teachers by sections 302A- and 302A- shall be available to teachers who teach in public charter schools, provided that the benefits conferred by this section shall not be available to a retired teacher rehired pursuant to the section added to chapter 302A by section 2 of Act 286, Session Laws of Hawaii 2006."
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $800,000, or so much thereof as may be necessary for fiscal year 2007-2008, to pay the bonuses to national board certificated teachers provided for in Section 2 of this Act. The sum appropriated shall be expended by the department of education for the purposes of this Act.
SECTION 5. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2007.
