A BILL FOR AN ACT

relating to conservation land.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  The legislature finds that telecommunication towers are becoming a public eyesore and are not esthetically pleasing in environments that are designated as state conservation areas.  Currently, there are no requirements or regulations that necessitate communication companies to camouflage their antennas.

     The purpose of this Act is to require all telecommunications towers, including cellular antennas and wireless communication antennas, located on state conservation land to be camouflaged to its environment in which it is located.

     SECTION 2.  Chapter 183C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§183C-   Telecommunications towers and antennas; camouflage. Every telecommunications tower, including cellular antennas and wireless communication antennas, that are located on conservation lands shall be appropriately camouflaged to match the surrounding environment.

The department shall establish requirements and standards consistent with this section."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
