A BILL FOR AN ACT
RElating to motor vehicle alarm systems.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§291C- Motor vehicle alarms systems; required technology. (a) Effective July 1, 2008, no manufacturer of a motor vehicle alarm system may cause to be sold or distributed in the State a motor vehicle alarm system that does not possess a component or device that electronically notifies the registered owner of the motor vehicle that the alarm has been activated for more than three continuous minutes.
(b) Effective July 1, 2008, no registered owner of a motor vehicle equipped with an alarm system that does not possess a component or device that electronically notifies the registered owner that the alarm has been activated for more than three continuous minutes shall operate a motor vehicle on the public highways, until the alarm system has been removed or the motor vehicle has been retrofitted with an alarm system that electronically notifies the registered owner that the alarm has been activated for more than three continuous minutes.
(c) Effective July 1, 2009, no registered owner of a motor vehicle shall install or use an audible vehicle alarm system.
(d) A person who violates this section shall be subject to the penalties set forth in section 291C-161."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2008.
