A BILL FOR AN ACT
RELATING TO GASOLINE DEALERS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature is informed that the ethanol content requirement in section 486J-10, Hawaii Revised Statutes, is causing problems to boaters throughout the State. The ethanol contained in the gasoline being sold in the State is having a damaging effect on motors in boats by breaking down certain contents or components in nonmetal parts of the boat fuel storage and distribution system resulting in the contamination of the fuel and damage to the boat engines.
The purpose of this Act is to require gasoline manufacturers in the State to make available in marine fueling stations and in at least one of their company retail stations in each state senatorial district gasoline not containing ethanol.
SECTION 2. Chapter 486H, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§486H- Provision of gasoline without ethanol content requirement. Each manufacturer shall make available, for sale, gasoline that does not contain the ethanol content required by section 486J-10 to the following:
(1) Marine fueling stations; and
(2) To the extent practicable, at least one company retail station owned by the manufacturer in each state senatorial district."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
