A BILL FOR AN ACT
RELATING TO ENVIRONMENTAL IMPACT STATEMENT .
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 343, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§343- Supplemental statement. (a) Notwithstanding the provisions of this chapter, the applicant or assigns, or an agency, having submitted an environmental impact statement that is accepted may be required, by the accepting authority, to submit a supplemental document if a period of ten years has elapsed since the acceptance, and the subject action has not been completed. This is required precedent to the implementation or continuance of the proposed action.
(b) After ten years following a finding of no significant impact, or an exemption determination, the accepting agency may require a new environmental assessment.
(c) A supplemental document, or new environmental assessment shall address the subjects required to be included in the original document plus any additional subjects required by this chapter that were enacted subsequent to the original acceptance.
(d) The procedures and timetable for submission shall be the same as required by this chapter for the corresponding documents.
(e) Acceptance of a required supplemental statement, a finding of no significant impact, or an exemption document shall be a condition precedent to the implementation or continuation of the action."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
