HOUSE RESOLUTION

 

 

REQUESTING THE MAYOR OF MAUI AND THE Maui COUNTY COUNCIL TO ESTABLISH A REAL PROPERTY TAX STRUCTURE BASED ON THE CALIFORNIA PROPOSITION 13 PROPERTY TAX SYSTEM.

 

 

 


     WHEREAS, on June 6, 1978, the voters of California enacted Proposition 13, the "People's Initiative to Limit Property Taxation"; and

 

     WHEREAS, the law provided that the maximum amount of any real property tax increase would not exceed one per cent of the full cash value of the property; and

 

     WHEREAS, the initiative resulted in a cap on property tax rates that reduced rates by an average of fifty-seven per cent; and

 

     WHEREAS, the law prevented older Californians from being priced out of their homes by ever-increasing property tax increases; and

 

     WHEREAS, the recent construction of large luxury homes and the recent boom in property sales on Maui has dramatically increased property tax rates in neighborhoods that are occupied by long-time middle-class residents; and

 

WHEREAS, many of these long-time residents live on fixed incomes and face the same economic prospects that their California counterparts faced and now live in fear of being priced out of their homes by exorbitant and unaffordable property tax increases; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2008, that the Mayor of Maui and the Maui County Council are requested to assist Maui residents by establishing a real property tax structure based on the California Proposition 13 property tax system; and

 

     BE IT FURTHER RESOLVED that the Mayor of Maui and the Maui County Council are requested to limit property tax rate increases to not more than a specified amount, such as two per cent per year, and to allow property tax rates to reflect the full market value of the real property only when the property is sold; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Mayor of Maui and the Chairperson of the Maui County Council.
