HOUSE CONCURRENT
RESOLUTION
requesting the department of the attorney general to investigate and determine the issue of ownership of ulaino road in maui.
WHEREAS, Ulaino Road is a four-mile gravel road in Maui that runs from the Hana Highway junction to the Muliwai in Ulaino; and
WHEREAS, although numerous homes are situated along Ulaino Road, a jurisdictional dispute exists over the ownership of the road; and
WHEREAS, despite a recent court decision that found the roadway to be privately owned, the Legislature believes that a legal opinion from the Attorney General would add more clarity to this issue; and
WHEREAS, the matter of jurisdictional responsibility must be resolved to provide necessary public services to residents with homes on Ulaino Road and to avoid future threats to their safety and well-being; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2008, the Senate concurring, that the Department of the Attorney General is requested to investigate and determine the issue of ownership of Ulaino Road; and
BE IT FURTHER RESOLVED that the Department of the Attorney General is requested to submit a report of any findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 2009; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Attorney General, the Director of Transportation, the Chairperson of the Board of Land and Natural Resources, and to the Mayor and the Chairperson of the Council of Maui County.
