HOUSE CONCURRENT
RESOLUTION
approving the resolution adopted by the board of land and natural resources designating certain public lands as an industrial park.
WHEREAS, industrial property is in short supply in the South Hilo area of the island of Hawaii, which is the subject of concern for industrial tenants in the area whose leases with the State are scheduled to expire soon; and
WHEREAS, development of a new industrial park would not only benefit industrial tenants, but also the State, by generating additional revenues; and
WHEREAS, section 171-134, Hawaii Revised Statutes (HRS), allows the Department of Land and Natural Resources (DLNR) to develop an area of public lands as an industrial park after the area of public lands is designated as an industrial park in accordance with section 171-132, HRS; and
WHEREAS, section 171-132, HRS, provides that a contiguous area of not less than five acres of public lands that is classified or otherwise determined by the Board of Land and Natural Resources (Board) as suitable and economically feasible for industrial use, may be designated as an industrial park by a resolution adopted by the Board, and approved by the Legislature by concurrent resolution; and
WHEREAS, DLNR desires to designate as an industrial park approximately 13.7 acres of contiguous public lands located at Waiakea, South Hilo, County and island of Hawaii, identified as Tax Map Keys (3) 2-1-12:41 and portions of (3) 2-1-12:71 and (3) 2-1-12:149 (the "Subject Area"); and
WHEREAS, the Subject Area is classified as urban under the state land use classifications and zoned for industrial use by the County of Hawaii; and
WHEREAS, DLNR intends to develop the Subject Area as part of an overall 25.4-acre project via a joint development effort with the Department of Hawaiian Home Lands, which owns an adjacent parcel consisting of approximately 11.7 acres; and
WHEREAS, at the February 22, 2008, Board meeting, the Board adopted a resolution designating the Subject Area as an industrial park under agenda item D-2; and
WHEREAS, the Legislature desires to provide approval of the resolution adopted by the Board to designate the Subject Area as an industrial park; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-Fourth Legislature of the State of Hawaii, Regular Session of 2008, the Senate concurring, that in conformance with section 171-132, HRS, the resolution adopted by the Board authorizing the designation of the properties identified as Tax Map Keys (3) 2-1-12:41 and portions of (3) 2-1-12:71 and (3) 2-1-12:149 as an industrial park, entitled "Board of Land and Natural Resources State of Hawaii Resolution Designating an Industrial Park" on February 22, 2008, under agenda item D-2 of the Board meeting on February 22, 2008, is approved; and
BE IT FURTHER RESOLVED that the Chairperson of the Board is authorized to withdraw portions of the Subject Area from the designation as an industrial park if the Chairperson determines that it is not feasible to develop the portions as part of the industrial park; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources and the Governor of the State of Hawaii.
