HOUSE CONCURRENT
RESOLUTION
urging the county of maui to adopt an ordinance limiting the number of time share units in maui county.
WHEREAS, it is in the State's best interest to foster a strong visitor market since the visitor industry is the largest generator of jobs in the State contributing directly and indirectly to the health and growth of the state economy; and
WHEREAS, the Department of Business, Economic Development, and Tourism has determined that hotel visitors on average spend more than twice as much per day in Hawaii as time share visitors; and
WHEREAS, according to the Maui County Department of Planning, the time share industry provides primarily low‑wage employment; and
WHEREAS, conversion of existing hotel units to time share units not only diminishes existing hotel room inventory, but also eliminates well‑paying jobs in the visitor hospitality sector thereby burdening the economy due to displaced workers; and
WHEREAS, in addition, conversion of existing hotel units to time share units reduces state revenue from the transient accommodations tax because resort time share vacation units do not generate as much taxable gross rental proceeds as hotel units; and
WHEREAS, the proliferation of time share units and diminution of hotel units negatively impacts the convention business and educational institutions, as both rely on hotel and conference rooms, not time share units; and
WHEREAS, residents of Hawaii typically rely on hotel rooms to facilitate interisland travel for business and to visit loved ones; and
WHEREAS, a reasonable cap on the number of time share units will create an incentive for more hotel construction on Maui and allow those in the construction trade to benefit from these future projects; and
WHEREAS, according to the Department of Business, Economic Development, and Tourism's 2006 Visitor Plant Inventory, there are approximately nineteen hundred seventy‑four time share units operating in Maui county and a cap of twenty‑two hundred will still provide for reasonable growth of the time share industry in Maui county; and
WHEREAS, the Maui County Council is considering a measure to limit the number time share units in Maui county to no more than twenty‑two hundred; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2008, the Senate concurring, that the county of Maui is urged to amend the Maui County Code to limit the number of time share units in Maui county to no more than twenty‑two hundred; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Mayor of Maui County, the Chairperson of the Maui County Council, and the Director of the Maui County Department of Planning.
