HOUSE CONCURRENT
RESOLUTION
REQUESTING A COMPARISON OF REVENUES FROM AND EXPENDITUREs FOR each state SMALL BOAT HARBOR.
WHEREAS, the Division of Boating and Ocean Recreation of the Department of Land and Natural Resources is responsible for the statewide boating program, which includes the operation, maintenance, and management of twenty-one state small boat harbors, fifty-four launching ramps, and thirteen offshore mooring areas; and
WHEREAS, the program is funded from the boating special fund established under section 248-8, Hawaii Revised Statutes; and
WHEREAS, under section 200-8, Hawaii Revised Statutes, the revenues of the boating special fund are required to be at least sufficient to pay the costs of the statewide boating program; and
WHEREAS, the revenues of the boating special fund are comprised of mooring fees, other user fees, and liquid fuel taxes derived from boaters; and
WHEREAS, under section 13-234-3, Hawaii Administrative Rules (Department of Land and Natural Resources), the Division has established five classes of small boat harbors, each of which is subject to different mooring rates; and
WHEREAS, the classes are as follows:
(1) "A" for Ala Wai;
(2) "B" for Keehi Lagoon, Honokohau, Maalaea, and Lahaina;
(3) "C" for Haleiwa, Heeia Kea, Waianae, Nawiliwili, Port Allen, Kailua-Kona, Keauhou, and Manele;
(4) "D" for Wailoa, Kikiaola, Kaunakakai, North Kawaihae, and Kukuiula; and
(5) "E" for South Kawaihae, Hana, Hale O Lono; and
WHEREAS, although no statute requires each small boat harbor to be financially self-sufficient, an examination should be made as to whether a situation exists where one small boat harbor, in fact, is being subsidized by other small boat harbors; and
WHEREAS, the results of such an examination will provide the Division and the Legislature with an additional tool to make policy and budgetary decisions regarding the State's boating program; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2008, the Senate concurring, that the Auditor is requested to compare the revenues generated from each small boat harbor listed under section 13-234-3, Hawaii Administrative Rules, against the operating, maintenance, and debt service expenditures for the harbor; and
BE IT FURTHER RESOLVED that the Auditor is requested to make the comparison for the past three completed fiscal years; and
BE IT FURTHER RESOLVED that, for the comparison, the Auditor is requested to reasonably apportion among the small boat harbors the liquid fuel taxes received by the boating special fund and overhead expenditures of the Division, Department, and central service agencies; and
BE IT FURTHER RESOLVED that the Auditor is requested to submit a report of findings and recommendations to the Legislature at least twenty days prior the convening of the Regular Session of 2009; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to Auditor and the Chairperson of the Board of Land and Natural Resources.
